ஹிஜாஸ் ஹிஸ்புல்லாவின் உரிமைக்காக சர்வதேச சட்டத்தரணிகள் சங்கம் முன்னிலையில் !

உயிர்த்த ஞாயிறு குண்டு தாக்குதல் தொடர்பாக கைது செய்யப்பட்டு தடுப்புக்காவலில் இருக்கும் ஜனாதிபதி சட்டத்தரணி ஹிஜாஸ் ஹிஸ்புல்லாவிற்கு  சட்டத்தரணிகளை சந்திக்கவும் சட்டத்தரணியாக அவரது தொழில்முறை சலுகைகளை மதிக்குமாறும் சர்வதேச சட்டத்தரணிகள் சங்கத்தின் மனித உரிமைகள் நிறுவனம் இலங்கை அரசிடம் கோரிக்கை விடுத்துள்ளது.

சர்வதேச சட்டத்தரணிகள் சங்கத்தின் மனித உரிமைகள் நிறுவனத்தின் இணைத் தலைவர்களான மைக்கல் கர்பி மற்றும் ஆன் ராம்பர்க் ஆகியோரின் கையொப்பங்களுடன் நீதித்துறை அமைச்சர் நிமல் சிரிபால டி சில்வாவுக்கு எழுத்துப்பூர்வமாக இந்த கோரிக்கை விடுக்கப்பட்டுள்ளது.

அந்த கடிதத்தின்படி, ஹிஜாஸ் ஹிஸ்புல்லா கைது செய்யப்பட்டதற்கான காரணம் குறித்து அவருக்கு அறிவிக்கப்படவில்லை எனவும் 2020 ஏப்ரல் 25ம் திகதி வரை தடுப்பு காவலில் வைக்குமாறு உத்தரவு பிறப்பிக்கப்படவில்லை எனவும் பயங்கரவாத தடுப்பு சட்டத்தின் 7 மற்றும் 9ம் பிரிவுகளுக்கு இணங்க 72 மணித்தியாலத்திற்குள் அவர் ஒரு நீதவான் முன் ஆஜர்படுத்தப்படவில்லை.

அதேபோல் அவரை கைது செய்திருப்பது கொவிட் 19 தொற்று நோய் பரவும் சந்தர்ப்பத்தில் எனவும் இலங்கையின் முஸ்லீம் சமூகம் மற்றும் அரசியல் எதிரிகளுக்கு எதிரான பாகுபாடு அதிகரித்து வருவதாகவும் சர்வதேச சட்டத்தரணிகள் சங்கத்தின் மனித உரிமைகள் நிறுவனம் இலங்கை அரசுக்கு சுட்டிக்காட்டியுள்ளது.

The International Bar Association has made an appeal from the Sri Lankan government to respect the professional privileges of President's Counsel Hejaaz Hizbullah, who is currently in custody over alleged connections to the Easter Sunday bombings, and allow him to channel his lawyers.

The letter of appeal signed by former justices Micheal Curby, who is the Co President of the Human Rights Institute of the International Bar Association, and Anne Ramberg has been forwarded to Minister of Justice Nimal Siripala De Silva.   

PC Hejaaz Hizbullah had not been informed of the reason for his arrest, nor a detention order had been issued pertaining to his arrest until April 25, 2020 and he had not been produced before a magistrate within 72 hours of the arrest in terms of sections 7 and 9 of the Prevention of Terrorism Act, they pointed out in the letter.

In brief meetings held on April 15, 16 and 18, 2020, a he has been barred from seeking legal assistance in violation of his professional privileges as a lawyer, they revealed.

The Human Rights Institute of the International Bar Association also denoted that Mr. Hizbullah was arrested amidst a time during which discrimination mounts against the Sri Lankan Muslim community and the political opponents over the COVID-19 Pandemic. Sor.lnw
